Shariah compliant Islamic Wills

for you and your loved ones

It is the duty of a Muslim who has something which is to be given as a bequest, not to have it for two nights without having his Will written down regarding it.
— Sahih Bukhari

Our goal: For every Muslim to have a legally binding Islamic will.

It is highly recommended that every Muslim with family or assets in the UK has a shariah compliant will that follows both Islamic law, UK wills regulations and complies with Quranic distribution. This is necessary to satisfy our religious duty and for it to be legally binding.

It is a common misconception, that a will has to be written by a solicitor or barrister, however, this is not necessary in England and Wales, and it is often better and permitted by law, for wills to be written by competent professionals that specialise in wills.

The validity of your will is essential for several reasons including to avoid family disputes, to allow probate applications to be made and so that the estate of the deceased may be disposed of according to their written wishes in compliance with the requirements of the shariah or Islamic law.

If death occurs and you do not have valid will, then it is likely that your family will not be able to gain control of your assets leaving the UK government with the authority to dispose of the assets according to the intestacy laws of England and Wales.

Since the UK intestacy laws differ from the shariah, this may result in your legal heirs being deprived of their Islamic rights and entitlement. It is your responsibility to ensure that this never happens.

Areas of Practice

Lasting Power of Attorney

We guide you through the process of arranging and registering a lasting power of attorney (LPA) to allow loved family members to be legally supported during their time of need. LPA’s may be arranged to allow trusted family members, friends or a professional attorney to manage the financial and / or health and care matters of your elderly parents or vulnerable family members. An LPA may only be set up whilst the mental health of the donor is sound.

Probate

We provide a full probate service to ensure that you can access the assets of your deceased family member. Most people are unaware that if the deceased assets exceed a certain value, then the UK government automatically freezes their estate (belongings, assets, bank accounts, pension funds etc). These may only be released and accessed by the family once a grant of probate is received. A full inheritance tax analysis is a prerequisite of this grant as well as other searches and legal checks. This is all included in the service we offer as well as a breakdown of the Islamic distribution to all eligible heirs.

Advisory Service

We provide professional advice on all matter related to your shariah compliant will including Islamic distribution in accordance with the Holy Quran, legal advice on guardianship, estate planning, asset protection and tax matters. Our wills are legally binding in England & Wales. Scottish legal wills are also available. Initial consultations are offered free of charge.

Legal Islamic Wills

We provide you with an Islamic Will that is tailored to your needs, compliant with the Islamic Law contained in the Holy Quran and the Sunnah of the Prophet Muhammad ﷺ. It is also compliant with UK Wills regulations to ensure that your wishes are legally binding in England & Wales. Will updates and amendments are also easily achievable and managed by the issue of a new will if required or a legally binding codicil. A robust set of guidance notes are also provided with your will to ensure that your will does not become unintentionally invalidated.

Trusts

We provide advice and guidance to help you choose a trust that is suited to your personal needs and goals. Trusts may be formed for several reasons including the protection of assets for your children or vulnerable family members, to protect against potential future health care costs or simply to reduce or completely mitigate inheritance taxes. Our services includes trust formation and registration with HMRC where required and are aligned with the shariah limitations.
